Органи Національної поліції України як суб’єкти запобігання та протидії домашньому насильству

Abstract

У статті звертається увагу на функції та компетенцію Національної поліції України як суб’єкта запобігання домашньому насильству. Діяльність уповноважених підрозділів Національної поліції відіграє важливу роль у боротьбі з домашнім насильством, оскільки саме ці уповноважені органи зобов’язані безпосередньо здійснювати низку профілактичних дій та заходів. The article draws attention to the functions and competence of the National Police of Ukraine as a subject of prevention of domestic violence. The activities of the authorized units of the National Police play an important role in the fight against domestic violence, as these authorized bodies are obliged to directly implement a number of preventive actions and measures. The purpose of writing this article is to study the legal regulation and powers of the National Police of Ukraine, which are authorized to take measures to prevent and combat domestic violence. Domestic violence is a form of violence. It differs from other types (on the street, during fights, during conflicts, in groups, etc.) in that it is committed by relatives or friends who have close relationships - blood, emotional, marital, intimate, economic, and so on. Therefore, preventing and combating domestic violence, as well as providing assistance to victims, is complicated by the fact that close people are involved in this offense. The issue of the work of the authorized units of the National Police occupies an important place in the issue of combating domestic violence, as this institution is obliged to directly implement a number of preventive (preventive) actions and measures. Please note that the main burden in the National Police on combating domestic violence rests with local police officers (patrol police, special police, etc.), these units must respond to these offenses if a citizen seeks help. The main characteristics of domestic violence: violence is always committed intentionally, ie in intentional actions. This means that the perpetrator was aware or should have been aware of the nature of his actions or omissions, foreseen or could foresee (based on his physical and mental condition) the possibility of such harmful consequences as causing physical or mental harm to the health of another family member.
