Abstract

У монографії досліджено філософсько-правові аспекти інтуїції. Обґрун-товано наукову спадщину досліджень та методологічний зміст інтуїції у праві. Монографію присвячено культурологічному дослідженню місця та значення інтуїції у праві, правових явищах, правових процесах. Зокрема здійснюється аналіз природно-правового сприйняття інтуїції, характеризуються інтуїтивні прояви у юридичній діяльності, її принципи та функції. При цьому інтуїтивно-юридична діяльність характеризується з позицій природного та позитивного права. У науковому дослідженні висвітлюється також моральний вимір інтуїтивної культури юриста, способи його інтуїтивно-культурологічного самовираження та значення культурологічного аспекту в інтуїтивному рішенні. The monograph explores the philosophical and legal aspects of intuition. It is substantiated the scientific heritage of research and the methodological content of intuition in law. The monograph is devoted to the cultural study of the place and significance of intuition in law, legal phenomena, legal processes. In particular, an analysis of natural-legal perception of intuition, characterized by intuitive manifestations of legal activity, its principles and functions. In this case, intuitive-legal activity is characterized by the position of natural and positive law. The scientific study also highlights the moral dimension of the intuitive culture of the lawyer, the ways of his intuitive cultural expression and the significance of the cultural aspect in an intuitive solution.
