Культурологічні проблеми правотворчості: дисертація

Abstract

Дисертація присвячена культурологічним проблемам процесу правотворчості на Україні, належного врахування різноманітних культурних та духовних чинників при створенні правових норм законодавцем з метою підвищення якості правового виробництва. В роботі дається всебічна характеристика права як явища культури з позицій філософсько-правової онтології, методології, гносеології та аксіології. Основна увага приділена дослідженню процесу правотворчості на суб’єктивному, об’єктивному, інтерсуб’єктному та державному рівнях. Проведений детальний аналіз культурологічно-антропологічних аспектів правотворчості. Розкрито культурологічні проблеми правотворчого процесу на Україні. Дисертація має практичне значення для підвищення ефективності основної функції законодавця – правотворчості, її філософсько-правового осмислення, для подальшого розвитку філософії права та теорії держави і права. Окремі положення та матеріали дисертації можуть використовуватися при викладанні філософії права, юридичної деонтології та культурології права у системі навчальних закладів юридичного профілю. The dissertation is dedicated to culturological problems of lawmaking process in Ukraine, necessary taking into account different cultural and spiritual issues while legal norms making by the legislator for the purpose of improvement of law production. In the paper there is a thorough description of law as cultural phenomenon, spheres of its manifestation and ways of forming are examined. From the aspect of philosophy of law there is an examination of the main point of interrelation of natural law existing out of culture and positive law as one of the systems of values belonging to culture. Much attention is paid to the detailed analysis of culturological and anthropological ideas of lawmaking. Spiritual nature of lawmaking process is shown. In the dissertation methodological principles of culturology of law are shown, cultural anthropology principles are determined. It is asserted that the law as a product of human activity, that is a product of culture, has to correspond to cultural anthropology principles. The dissertation is in practical importance in regard to improvement of efficiency of the main function of lawmaker – lawmaking, its philosophical and legal comprehension, further development of philosophy of law and theory of state and law.
