Правові засади захисту національних інтересів держави у сфері забезпечення суверенітету та територіальної цілісності України

Abstract

Статтю присвячено дослідженню питання правових засад захисту національних інтересів держави у сфері забезпечення суверенітету та територіальної цілісності України в сучасних умовах. Авторка доводить, що за своєю сутністю національні інтереси є інтегральним вираженням інтересів усіх членів суспільства, що реалізується через політичну систему та забезпечує поєднання в собі інтересів кожної людини, інтересів національних, соціальних, політичних груп з інтересами держави. Національні інтереси охоплюють широкий спектр відносин у державі та містять такі основні елементи, як військова безпека, економічна стабільність і розвиток та державний суверенітет як контроль за певною територією та населенням. У статті зазначено, що в Україні правові засади захисту національних інтересів держави закріплюються на конституційному та законодавчому рівнях, а також у низці міжнародних документів. Така нормативна регламентація дає змогу оптимального нормативно-правового регулювання цього питання та визначає напрями подальшого розвитку України, що стають можливими за наявності ефективного забезпечення суверенітету та територіальної цілісності держави. Робиться висновок, що в умовах сучасних викликів і загроз національним інтересам України політика забезпечення національних інтересів спрямована на виконання таких завдань: по-перше, захист державного суверенітету (тобто верховенства, самостійності, повноти і єдності державної влади в межах її території, а також незалежності й рівноправності держави в зовнішніх відносинах); по-друге, захист територіальної цілісності та національної безпеки держави (протидія сепаратизму, протидія територіальним претензіям із боку інших країн, запобігання спроб утручання у внутрішні справи держави). Реалізація національних інтересів можлива лише за умови нормального функціонування системи національної безпеки України, тобто необхідних заходів забезпечення державного суверенітету, територіальної цілісності, демократичного конституційного ладу та інших національних інтересів від реальних та потенційних внутрішніх і зовнішніх загроз. The article is devoted to the study of the legal basis for the protection of national interests of the state in the feld of ensuring the sovereignty and territorial integrity of Ukraine in modern conditions. The author argues that in essence national interests are an integral expression of the interests of all members of society, realized through the political system and provides a combination of interests of each person, the interests of national, social, political groups with the interests of the state. National interests cover a wide range of relations in the state and include such basic elements as military security, economic stability and development, and state sovereignty as control over a certain territory and population. The article states that in Ukraine the legal basis for the protection of national interests of the state is enshrined at the constitutional and legislative levels, as well as in a number of international documents. Such normative regulation allows for optimal normative-legal regulation of this issue and determines the directions of further development of Ukraine, which become possible in the presence of effective provision of sovereignty and territorial integrity of the state. It is concluded that in the context of modern challenges and threats to the national interests of Ukraine, the policy of ensuring national interests is aimed primarily at fulflling the following tasks: frst – protection of state sovereignty (supremacy, independence, completeness and unity of state power within its territory); as well as the independence and equality of the state in foreign relations); secondly, protection of the territorial integrity and national security of the state (counteraction to separatism, counteraction to territorial claims by other countries, prevention of attempts to interfere in the internal affairs of the state). Realization of national interests is possible only under the condition of normal functioning of the national security system of Ukraine, necessary measures to ensure state sovereignty, territorial integrity, democratic constitutional order and other national interests from real and potential internal and external threats.
