Abstract

Публікацію присвячено дослідженню системи міжнародної охорони прав організацій мовлення як особливого суб’єкта суміжних прав. Розкрито особливості конвенційної міжнародної охорони, проаналізовано директиви ЄС та регіональні угоди. Зосереджено увагу на перспективному міжнародному регулюванні розглядуваної сфери відносин. Констатовано, що чинні міжнародні та регіональні договори не гарантують організаціям мовлення належного рівня охорони їх прав та можливості захистити та реалізувати свої інвестиції у зв’язку з поширенням програм (передач) у цифровому форматі та глобальній мережі Інтернет. Обґрунтовано доцільність перегляду обсягу та змісту суб’єктивних майнових прав організацій мовлення. Для забезпечення належного рівня охорони організацій мовлення в епоху розвитку цифрових та мультимедійних технологій запропоновано прийняти уніфікований міжнародний документ про охорону прав організацій мовлення, у якому були б ураховані технологічні досягнення та усунені основні недоліки існуючої міжнародної охорони. The publication is devoted to the study of the system of international protection of the rights of broadcasting organizations as a special subject of related rights. The peculiarities of conventional international protection are revealed, EU directives and regional agreements are analyzed. The focus is on promising international regulation of this area of relations. It is stated that the current international and regional agreements do not guarantee broadcasting organizations the appropriate level of protection of their rights and the ability to protect and realize their investments in connection with the distribution of programs in digital format and the global Internet. The expediency of reviewing the scope and content of subjective property rights of broadcasting organizations is substantiated. To ensure the appropriate level of protection of broadcasting organizations in the era of digital and multimedia technologies, it is proposed to adopt a unified international document on the protection of broadcasting organization, which would take into account technological advances and eliminate major shortcomings of existing international protection.
