Курсанти закладів освіти МВС України як суб’єкти державно-службових відносин

Abstract

На підставі аналізу чинного законодавства, застосовуючи системний метод дослідження правових явищ, розглянуто діяльність курсантів закладів освіти МВС України як суб’єктів державнослужбових відносин. Досліджено теоретичні засади визначення суб’єкта державно-службових відносин, особливості правового статусу курсантів закладів освіти МВС та реалізацію правового статусу курсанта закладу освіти МВС України. Визначено специфіку функціонування курсантів, які навчаються в закладах освіти МВС України, у державно-службових, владних і освітніх відносинах, що зумовило їх класифікацію за такими підставами: залежно від режиму перебування, обсягу занять (які навчаються за очною формою; навчаються за заочною формою); залежно від характеру виконуваних функцій і наданих повноважень у співвідношенні з реалізованою спеціалізацією: поліцейський карного розшуку (правоохоронна діяльність); поліцейський органів дізнання, слідства (правове забезпечення досудового слідства); поліцейський служби дільничних офіцерів поліції, поліцейський офіцер громади (правоохоронна і адміністративна діяльність); поліцейський патрульної служби (адміністративна діяльність); залежно від положення курсанта в освітньому колективі (курсант, командир відділення, заступник командира взводу); залежно від рівня освоюваної освітньої програми, форми навчання, режиму перебування у закладі освіти (курсант, слухач, ад’юнкт). Based on the analysis of current legislation, using a system method of studying legal phenomena, the activities of cadets of educational institutions of the Ministry of Internal Affairs of Ukraine as subjects of public service relations are considered. Theoretical bases of defnition of the subject of public service relations, features of the legal status of cadets of educational institutions of the Ministry of Internal Affairs and implementation of the legal status of the cadet of educational institutions of the Ministry of Internal Affairs of Ukraine are investigated. The special features of the functioning of cadets studying in educational institutions of the Ministry of Internal Affairs of Ukraine, in public service, government and educational relations, which led to their classifcation on the following grounds, are determined. They are: depending on the regime of stay, the form of studying (full-time; part-time); depending on the nature of the functions performed and the powers granted in relation to the implemented specialization: criminal investigation ofcer (law enforcement); police of bodies of inquiry, investigation (legal support of pre-trial investigation); police ofcer of district police ofcers, community police ofcer (law enforcement and administrative activities); police patrol service (administrative activities); depending on the position of the cadet in the educational team (cadet, commander, deputy commander); depending on the level of the mastered educational program, the form of education, the regime of stay in the educational institution (cadet, student, adjunct). It is noted that the optimization of cadet service in the educational institution of the Ministry of Internal Affairs of Ukraine is associated with the harmonization of elements of power, service and educational segment in the structure of administrative and legal status, so age requirements for candidates must be organically combined with other parameters, the possibility of purposeful and active functioning in the process of law enforcement, i.e. it is necessary to bring these components of the status in line.
