Правові гарантії участі захисника у кримінальному провадженні

Abstract

У статті здійсненний аналіз певних рішень Європейського суду з прав людини та положень чинного кримінального процесуального законодавства України щодо реалізації права на захист через адвоката. Розглянуто правові гарантії участі захисника у кримінальному провадженні та права підозрюваного, обвинуваченого, підсудного на участь адвоката з метою захисту їхніх прав. Зазначено та проаналізовано реалізації прав захисника у кримінальному провадженні у кримінальному провадженні на різних стадіях кримінального процесу. The article analyzes certain decisions of the European Court of Human Rights and the provisions of the current criminal procedure legislation of Ukraine on the exercise of the right to defense through a lawyer. The legal guarantees of the defense counsel's participation in the criminal proceedings and the right of the suspect, accused, defendant to the participation of a lawyer in order to protect their rights are considered. The realization of the rights of a defense counsel in criminal proceedings in criminal proceedings at different stages of the criminal process is indicated and analyzed.
