Правові засади державного ветеринарно-санітарного контролю під час здійснення експортно-імпортних операцій

Abstract

Проаналізовано законодавство України, що регулює порядок здійснення державного ветеринарно-санітарного контролю під час експортноімпортних операцій. Розкрито особливості такого контролю та наголошено на необхідності вдосконалення його правового регулювання. Охарактеризовано прийняття Закону України «Про державний контроль за дотриманням законодавства про харчові продукти, корми, побічні продукти тваринного походження, здоров’я та благополуччя тварин», а також запровадження принципу «єдиного вікна» під час здійснення ветеринарно-санітарного контролю. The article deals with the analyses of the legislation of Ukraine that regulates the procedure of implementing the state veterinary-sanitary control during export-import transactions. The author emphasizes that the basic normative and legal act, which determines the legal and organizational principles of implementing the state veterinary and sanitary control, is the Law of Ukraine «On Veterinary Medicine», according to which the state veterinary-sanitary control is functions discharged by state inspectors of veterinary medicine and/or authorized doctors of veterinary medicine that consist in constant checking adherence to the veterinary-sanitary requirements established by legislation. State veterinary and sanitary control of export-import transactions is carried out by state border inspectors of veterinary medicine – state inspectors of regional services of state veterinary-sanitary control and supervision at the state border and on transport, their structural subdivisions. The procedure of implementing the state veterinary-sanitary control during export-import transactions is regulated by the Laws of Ukraine «On Basic Principles and Requirements for the Safety and Quality of Food Products» and «On the State Control of Compliance with Law concerning Foodstuff, Forages, ByProducts of Animal Origin, Health and Wellbeing of Animals» (will come into force on 04 April 2018) and by-laws. The mentioned laws were adopted for the implementation of Chapter 4 of «Sanitary and Phytosanitary Measures» of the Association Agreement with the European Union, the European Atomic Energy Community and their Member States.
