Громадський контроль за діяльністю органів прокуратури як гарантія дотримання прав людини в Україні

Abstract

У статті розкрито особливості здійснення громадського контролю за діяльністю органів прокуратури як однієї із гарантій дотримання прав людини в Україні. Встановлено, що громадський контроль, який проводиться за діяльністю органів прокуратури визначається як установлена законом діяльність, яку здійснюють представники громадськості. Визначено, що ключовими інституційними елементами такого контролю є суб’єкт контролю, об’єкт контролю, предмет контролю, процедури звільнення від контролю. Зазначено, що є такі форми громадського контролю за діяльністю органів прокуратури, як: участь громадськості у процесах обговорення і підготовлення нормативно-правових документів; звернення громадян чи інститутів громадянського суспільства у безпосередній формі спільно із представниками засобів масової інформації до органів прокуратури з ціллю одержання від них інформації щодо особливостей та результатів їх діяльності; участь громадян та/чи інститутів громадянського суспільства у процесах відбору кандидатів, які претендують на посади у органах прокуратури; проведення опитувань громадян щодо їх думки про особливості та результати діяльності органів прокуратури. З’ясовано, що забезпечення постійного і ґрунтовного інформування громадськості про діяльність органів прокуратури щодо додержання прав та свобод людини і громадянина сприятиме підвищенню рівня довіри громадян та суспільства загалом до діяльності органів прокуратури і прокурорів зокрема. Зазначено, що перспективами подальших досліджень у цьому напрямі є дослідження особливостей судового контролю як однієї із ключових гарантій діяльності органів прокуратури за дотриманням прав та свобод людини і громадянина в Україні. The article reveals the features of public control over the activities of the prosecutor's office as a guarantee of human rights observance in Ukraine. It has been established that the public control carried out over the activities of the prosecution authorities is defined as the activities established by law, which are carried out by members of the public. It has been determined that the key institutional elements of such control are the subject of control, the object of control, the subject of control, and the procedures for release from control. It is noted that there are such forms of public control over the activities of the prosecution authorities, such as: public participation in the processes of discussion and preparation of legal documents; appeal of citizens or civil society institutions in direct form, together with representatives of the media, to the prosecution authorities in order to obtain information from them about the features and results of their activities; participation of citizens and/or civil society institutions in the selection processes of candidates applying for positions in the prosecutor's office; conducting surveys of citizens in their opinion about the features and results of the activities of the prosecutor's office. It has been found that ensuring constant and thorough public information about the activities of the prosecution authorities on the observance of human and civil rights and freedoms will help to increase the level of confidence of citizens and society as a whole to the activities of the prosecutor's office and prosecutors in particular. It is noted that the prospects for further research in this direction is to study the features of judicial control as one of the key guarantees of the activities of the prosecutor's office for the observance of human and civil rights and freedoms in Ukraine.
