Нормативно-правове врегулювання інформаційного забезпечення Національної поліції щодо протидії незаконному заволодінню транспортними засобами

Abstract

У статті розглянуто актуальні проблеми нормативно-правового врегулювання інформаційного забезпечення Національної поліції щодо протидії незаконному заволодінню транспортними засобами. In the paper the issues of normative and legal regulation of an information support of the counteraction of the National Police to the misappropriation of vehicles are considered. The authors argue that the legal basis of an information support of the counteraction of the National Police to the misappropriation of vehicles is the system of legislation determining the admissibility of this activity, as well as by-laws and rules regulating its procedure and conditions. Legislative acts that define the basic principles of the counteraction of the National Police to the misappropriation of vehicles are: the Constitution of Ukraine, the Criminal and Criminal Procedural Codes of Ukraine, Laws of Ukraine «About the National Police», «About Operative and Search Activity», «About the Organizational and Legal Bases of the Struggle with the Organized Crime», «About the State Border Service of Ukraine», «About Road Traffic» and «About the Amendments to Some Legislative Acts of Ukraine for the Improvement of Regulation of the Relations in the field of Road Traffic Support» and others. It is noted, that until recently the organization of the information support of the counteraction of the National Police to the misappropriation of vehicles and application of the specific information systems have been regulated by the departmental instructions of the Ministry of Internal Affairs. It is emphasized, that nowadays the issues about regulatory settlement of the information support of police of the counteraction of the National Police to the misappropriation of vehicles at the departmental levels is actual.
