Застосування інформаційних технологій в цивільному процесі України

Abstract

У статті аналізуються окремі питання застосування інформаційних технологій в цивільному процесі України. Автори підкреслюють, що інформаційні технології відіграють важливу роль в захисті прав людини. Впровадження нових інформаційних технологій у цивільне судочинство є загальносвітовою тенденцією. Кожна країна має свій шлях інформатизації цивільного судочинства. Це залежить від часу застосування технологій, від обсягу та змісту заходів, що проводяться. Проте адаптація інформаційних технологій для цілей цивільного судочинства неможлива без формування нормативної основи та створення відповідного спеціалізованого програмного забезпечення. У статті зазначається, що застосування та використання інформаційних технологій у цивільному процесі має ознаку системності і наводяться елементи цієї системи. Автори роблять висновок, що застосування інформаційних технологій в цивільному судочинстві дозволяє дистанційно спілкуватися з учасниками процесу та полягає у бездокументарній формі передачі документів, що здійснюється з використанням інформаційних технологій (мережі Інтернет, інших засобів телекомунікаційного зв’язку), які є альтернативними засобами спілкування. У даний час нові технології можуть дати надто багато. Доцільно досліджувати правові наслідки використання інформаційних технологій у цивільному процесі; оцінити систему електронного правосуддя та її елементи на відповідність традиційним принципам та вивчити можливі зміни у реалізації принципів цивільного процесу. В умовах застосування інформаційних технологій у цивільному процесі важливо знайти баланс між вимогою стабільності та необхідністю реагувати на зміну суспільних відносин. Інформаційні технології дозволяють скорочувати час, усувати недоліки територіального фактора, мінімізувати фінансові та трудові витрати. Це може і має служити вирішенню завдань цивільного судочинства, забезпечуючи високу ступінь доступності правосуддя. The article analyzes individual issues of the use of information technologies in the civil process of Ukraine. The authors emphasize that information technologies play an important role in the protection of human rights. The introduction of new information technologies into civil proceedings is a global trend. Each country has its own way of informatization of civil proceedings. It depends on the time of application of technologies, on the scope and content of the events being held. However, the adaptation of information technologies for the purposes of civil justice is impossible without the formation of a regulatory framework and the creation of appropriate specialized software. The article states that the application and use of information technologies in the civil process has a sign of systematicity and the elements of this system are given. The authors conclude that the use of information technologies in civil proceedings allows for remote communication with the participants in the process and consists in a documentless form of document transfer, which is carried out using information technologies (the Internet, other means of telecommunications), which are alternative means of communication. Currently, new technologies can give too much. It is appropriate to investigate the legal consequences of the use of information technologies in civil proceedings; evaluate the electronic justice system and its elements for compliance with traditional principles and study possible changes in the implementation of the principles of civil procedure. In the context of the application of information technologies in the civil process, it is important to fnd a balance between the requirement of stability and the need to respond to changes in social relations. Information technologies make it possible to reduce time, eliminate the shortcomings of the territorial factor, and minimize fnancial and labor costs. This can and should serve to solve the tasks of civil justice, ensuring a high degree of access to justice.
