Бланкетні диспозиції в статтях Особливої частини Кримінального кодексу України: монографія

Abstract

У роботі міститься комплексне дослідження бланкетних диспозицій в статтях Особливої частини Кримінального кодексу України: їх поняття, види, співвідно- шення з іншими формами міжгалузевого зв’язку кримінального закону. Розглянуто історичний та зарубіжний досвід використання бланкетних відсилок при форму- люванні кримінально-правових заборон; проаналізовано особливості бланкетних диспозицій в статтях Особливої частини Кримінального кодексу України залежно від того, ознаки якого елементу складів злочинів характеризує бланкетна вказівка. Сформульована концепція формулювання бланкетних вказівок на ознаки складів злочинів у ході правотворчості та правозастосування щодо статей Кри- мінального кодексу України з такими диспозиціями, найважливішими складо- вими якої є визначення допустимого рівня бланкетності; окреслення переліку джерел права, які конкретизують зміст бланкетних диспозицій; формулювання напрямів вдосконалення статей Кримінального кодексу України з бланкетними диспозиціями. The monograph is a comprehensive study of blanket dispositions in the articles of the Special Part of the Criminal Code of Ukraine. The following questions are investigated: the concept of blanket dispositions, types, relations with other forms of interbranch communication of the criminal law. The historical and foreign experiences of using blankets in the formulation of criminal and legal prohibitions; the peculiarities of blanket dispositions in the articles of the Special Part of the Criminal Code of Ukraine are analyzed (depending on the characteristics of which the element of the syllables of crimes characterizes the blanket instruction.) Also in the work there is formulated the concept of application of blanket norms for the legislator. For practical workers, there are defined rules for determining the acceptable level of blanket. The most important components of which is the determination of the acceptable level of blanketness, is formulated; outlining the list of sources of law that specify the content of blanket dispositions; formulation of directions for improvement of articles of the Criminal Code of Ukraine with blanket dispositions.
