Об'єктивні ознаки розбою за кримінальним правом Республіки Польща

Abstract

У статті із застосуванням порівняльного методу аналізується склад злочину "розбій", пердбачений статтею 280 Кримінального кодексу Республіки Польща. Автор обгрунтовує положення про відмінність розбою за кримінальним правом України від розбою за кримінальним правом Республіки Польща. Встановлено, що розбій за Кримінальним кодексом Республіки Польща є кваліфікованим видом крадіжки. Розкрито об'єкт і предмет розбою, характер насильства, що застосовується до потерпілого при вчиненні розбою. Вказано на значення доведення потерпілого до непритомного чи безпорадного стану як ознака об'єктивної сторони складу розбою. The article, using the comparative method, analyzes the composition of the crime of "robbery", provided for by Article 280 of the Criminal Code of the Republic of Poland. The author substantiates the provision on the difference between robbery under the criminal law of Ukraine and robbery under the criminal law of the Republic of Poland. It has been established that robbery is a qualified type of theft under the Criminal Code of the Republic of Poland. The object and subject of the robbery, the nature of the violence applied to the victim during the robbery is disclosed. The value of bringing the victim to an unconscious or helpless state is indicated as a sign of the objective side of the composition of the robbery.
