Підстави порушення прав людей у воєнний час

Abstract

Ми живемо в сучасному світі де не можна уявити себе без певних прав та з обмеженням свобод. Ми народились вільними, вільними звикли бути та вільними і хочемо зостатись. Сучасні умови диктують нам різні умови для прояву своєї свободи та своїх прав. Але не можемо не погодитись що із початком повномасштабної війни 24 лютого 2022 року певні права наші довелось притіснити уряду країни. А от чи впливає це на суспільство, треба розібратись. В Конституції України, яка є головним законом нашої держави, сказано, що всі люди є вільні та рівні у своїх правах, своїй гідності. Що всі наші права і свободи є непорушними і невідчужуваними. Звичайно навіть в умовах воєнного стану повністю відмінити або скасувати певні права і свободи людини і громадянина не можливо. Адже для цього необхідно внести зміни до Конституції України, а це заборонено згідно ч.1 ст. 19 Закону України «Про правовий режим військового стану» – «Гарантії законності в умовах воєнного стану». Проте під час сучасного правового стану в Україні можуть бути обмеженні такі права гарантовані Основним законом, а саме: права на рівність та повагу до гідності особи; право на особисту недоторканість; право на укладання шлюбу; право на громадянство; право на справедливий суд, юридичну допомогу та захист; право на житло. Проте, ніхто і ніякий правовий стан (тимчасовий чи постійний) не може обмежити найголовніше наше право – право людини на життя. Це право захищене не тільки Конституцією України, а і міжнародними правовими документами, ратифіковані Верховною Радою України. Сьогодні наша країна бореться за те, щоб це право ніхто не міг у нас відібрати, спаплюжити, знехтувати. Адже сьогодні українець не перелякана людина, а мужній воїн. За його спиною безпека не тільки нашої країни, а і безпека всього демократичного світу. Саме це є пріорітетом для всього нашого народу та керівництва країни. Modern conditions dictate different conditions for us to exercise our freedom and our rights. But we cannot but agree that with the beginning of a full-scale war on February 24, 2022, certain of our rights had to be suppressed by the country’s government. But whether this affects society, we need to fgure it out. The Constitution of Ukraine, which is the main law of our state, states that all people are free and equal in their rights and dignity. That all our rights and freedoms are inviolable and inalienable. After all, for this, it is necessary to make changes to the Constitution of Ukraine, and this is prohibited according to Part 1 of Art. 19 of the Law of Ukraine “On the Legal Regime of Martial Law” – “Guarantees of legality under martial law”. However, under the current legal situation in Ukraine, such rights guaranteed by the Basic Law may be limited, namely: the right to equality and respect for the dignity of the person; the right to personal integrity; the right to marry; the right to citizenship; the right to a fair trial, legal aid and protection; the right to housing. This right is protected not only by the Constitution of Ukraine, but also by international legal documents ratifed by the Verkhovna Rada of Ukraine. Today, our country is fghting so that no one can take this right away from us, slander, neglect it. After all, today a Ukrainian is not a frightened person, but a courageous warrior. Behind him is the security of not only our country, but also the security of the entire democratic world. This is the priority for all our people and the leadership of the country.
