Концепція зміни системи кримінально-правового регулювання в умовах «стійкого розвитку»

Abstract

У статті визначено, що в Україні на теперішній час не існує єдиної концепції, в рамках якої ідеї кримінально-правової політики, положення науки кримінального права, кримінальна законотворчість та застосування норм кримінального права діяли б сукупно, випливаючи одне з іншого і зворотно впливаючи. Визначено поняття «Sustainable development» як розвиток, який відповідає потребам дійсності, не ставлячи під загрозу здатність майбутніх поколінь задовольняти свої власні потреби. Автор дійшла висновку, що для розроблення науково виваженої ефективної концепції побудови оптимальної динаміки кримінального права, яка відповідає соціальному запиту та відштовхується від певних детермінантів, що визначають «як, чому й куди» має рухатися сучасне вітчизняне кримінальне право, слід запропонувати Концепцію зміни системи кримінально-правового регулювання в умовах «стійкого розвитку» («Sustainable development»). The article determines that there is currently no single concept in Ukraine, within which the ideas of criminal law policy, the provisions of the science of criminal law, criminal lawmaking and the application of criminal law norms would act together, resulting from one another and having a reciprocal influence. The concept of “Sustainable development” is defined as development that meets the needs of reality without jeopardizing the ability of future generations to meet their own needs. The author came to the conclusion that in order to develop a scientifically balanced and effective concept of building the optimal dynamics of criminal law, which corresponds to social demand and is based on certain determinants that determine “how, why and where” modern domestic criminal law should move, the Concept of changing the system of criminal law should be proposed regulation in the conditions of “Sustainable development”.
