Правове забезпечення економічної безпеки держави в умовах Індустріії 4.0

Abstract

На підставі аналізу діючого законодавства встановлено, що на даний час не приділено належної уваги забезпеченню економічної безпеки у системі національної безпеки держави в умовах Індустрії 4.0. Але з позицій цифровізації Індустрія 4.0 є ключовим етапом цифрової трансформації національної економіки України та екосистем різного рівня. Запропоновано внести зміни і доповнення до законів України «Про національну безпеку України», «Про Бюро економічної безпеки України», «Про основні засади забезпечення кібербезпеки України», «Про стимулювання розвитку цифрової економіки в Україні»; Стратегії національної безпеки України; Стратегії кібербезпеки України в частині створення належних інституційних умов для забезпечення економічної безпеки держави у контексті впровадження концепцій і технологій Індустрії 4.0. Встановлено, що доцільно розробити й схвалити Концепцію розвитку цифрової економіки та суспільства України на 2023–2027 роки, у якій визначити механізми забезпечення економічної безпеки держави у контексті цифрових трансформацій, а також затвердити План заходів щодо їх реалізації. Пропонується розробити Стратегію економічної безпеки України на період до 2035 року в умовах Індустрії 4.0. Currently, there is a change in the paradigm of economic security of the state in the direction of digital transformation of economic systems. The purpose of this study is to consider the features of the development of the economic security system in the context of global digital transformations; analysis and generalization of the legal basis for ensuring the economic security of the state in the conditions of Industry 4.0. To achieve the goal, the methods of analysis and synthesis, system approach, comparisons and observations, classifcation, structural and logical generalization were used. Based on the analysis of the current legislation, it has been established that due attention has not been paid to ensuring economic security in the state's national security system under the conditions of Industry 4.0. But from the point of view of digitalization, Industry 4.0 is a key stage of the digital transformation of the national economy of Ukraine and ecosystems of various levels. The defnition of the terms "Industry 4.0", "digital transformation", "economic security of the state in the conditions of Industry 4.0" remains an urgent issue. It was established that the general provisions on the economic security of the state must be included in the laws of Ukraine "On the basic principles of ensuring cyber security of Ukraine", "On stimulating the development of the digital economy in Ukraine"; Decree of the President of Ukraine "On the decision of the National Security and Defence Council of Ukraine dated May 14, 2021 "On the Cybersecurity Strategy of Ukraine"; Decree of the Cabinet of Ministers of Ukraine "Some issues of digital transformation" and "On approval of the Concept of the development of digital competences and approval of the plan of measures for its implementation". It is proposed to introduce changes and additions to the laws of Ukraine "On the National Security of Ukraine", "On the Bureau of Economic Security of Ukraine", "On the Basic Principles of Ensuring Cyber Security of Ukraine", "On Stimulating the Development of the Digital Economy in Ukraine"; National security strategies of Ukraine; Cybersecurity strategies of Ukraine in terms of creating appropriate institutional conditions to ensure the economic security of the state in the context of the implementation of Industry 4.0 concepts and technologies. It has been proven that it is expedient to develop and approve the Concept of the Development of the Digital Economy and Society of Ukraine for 2023–2027, in which to determine the mechanisms for ensuring the economic security of the state in the context of digital transformations, as well as to approve the Plan of measures for their implementation. It is proposed to develop the Strategy of Economic Security of Ukraine for the period until 2035 under the conditions of Industry 4.0.
