Вплив Конституційного Суду України на формування домінуючого вітчизняного праворозуміння

Abstract

Стаття присвячена дослідженню ролі Конституційного Суду України у формування домінуючого вітчизняного праворозуміння в сучасних умовах та його впливу на практику застосування права і розвиток національної правової системи. Розкривається сутність домінуючого праворозуміння як це особливого розуміння змісту права, що складається в суспільстві як найбільш впливове і поширене та визначає функціонування правової системи. Доводиться, що Конституційний Суд України, керуючись принципом верховенства права, бере участь у формуванні сучасного вітчизняного домінуючого праворозуміння. The article is devoted to the study of the role of the Constitutional Court of Ukraine in the formation of the dominant domestic legal understanding in modern conditions and its influence on the practice of applying the law and the development of the national legal system. The essence of the dominant legal understanding is revealed as a special understanding of the content of law, which is formed in society as the greatest influence and expands and ensures the functioning of the legal system. It is proved that the Constitutional Court of Ukraine, guided by the principle of the rule of law, participates in the formation of the modern domestic dominant legal understanding.
