Співвідношення органів державної влади та місцевого самоврядування та їхня роль у формуванні демократичного суспільства

Abstract

В статті розглянуто питання співвідношення та взаємодії органів державної влади та місцевого самоврядування, як спеціального виду управлінських правових відносин, роль яких полягає у вирішенні спільних завдань та цілей, на засадах рівності та оптимального співвідношення інтересів у сфері муніципального управління, які виражаються у поєднанні ресурсів, узгодженні та координації дій учасників цих відносин. Актуальність дослідження даної теми полягає в тому, що розширенню демократичної основи державної влади сприяє взаємодія апарату держави з місцевим самоврядуванням, що в свою чергу забезпечує реалізацію конституційного права громадян на участь в управлінні державними справами. Тому компроміс суспільних інтересів забезпечує саме ця взаємодія, що в певній мірі сприяє розвитку демократичного суспільства, а отже забезпечує стабільний, стійкий розвиток держави і суспільства. Розглянуто досвід Української держави та зарубіжних держав щодо організації місцевого самоврядування, який свідчить про тісний взаємозв’язок, взаємопроникнення та взаємозалежність само управлінських і державних засад. Виявити ряд їхніх загальних ознак дав змогу аналіз співвідношення місцевого самоврядування та держави. При дослідженні даного питання також було звернено увагу на загальні політико-правові, духовно-культурні, соціально-економічні основи, які є підґрунтями для побудови української держави та самоврядування. Також закріплення на законодавчому рівні загальні принципи організації й діяльності органів державної влади і місцевого самоврядування, в особливості: гласність, законність, народовладдя, виборність представницьких органів, їхня незалежність і самостійність один від одного, а також від суспільних об’єднань, оптимальне поєднання централізації й децентралізації, врахування суспільної думки. The article examines the issue of the relationship and interaction of state authorities and local self-government bodies, as a special type of managerial legal relations, the role of which is to solve common tasks and goals, on the basis of equality and the optimal balance of interests in the feld of municipal management, which are expressed in the combination of resources, agreement and coordination of actions of the participants of these relations. The relevance of the study of this topic lies in the fact that the expansion of the democratic basis of state power is facilitated by the interaction of the state apparatus with local selfgovernment bodies, which in turn ensures the realization of the constitutional right of citizens to participate in the management of state affairs. Therefore, it is precisely this interaction that provides a compromise of public interests, which to a certain extent contributes to the development of a democratic society, and therefore ensures stable, sustainable development of the state and society. The experience of foreign states regarding the organization of local self-government bodies, which testifes to the close relationship, interpenetration and interdependence of selfgovernment and state institutions, is considered. An analysis of the relationship between local self-government and the state made it possible to identify a number of their common features. When studying this issue, attention was also paid to the general political-legal, spiritualcultural, socio-economic foundations, which are the foundations for the construction of the Ukrainian state and self-government. Also, fxing at the legislative level the general principles of organization and activity of state authorities and local self-government bodies, in particular: transparency, legality, people’s rule, electability of representative bodies, their independence and autonomy from each other, as well as from public associations, optimal combination of centralization and decentralization, taking into account public opinion.
