Основні напрями формування довкіллєвої безпекової складової як пріоритету у відновленні України

Abstract

У статті проведено аналіз програми «Відбудова чистого та захищеного середовища», що є складовою проєкту Плану відновлення України. Досліджено п’ять основних напрямів державної екологічної політики, для реалізації кожного з яких у програмі передбачено реалізацію ряду реформ, в межах яких мають бути здійснені відповідні проєкти. Загалом аналізуючи стратегічні цілі, завдання, проєкти та заходи національної програми «Відбудова чистого та захищеного середовища» у контексті відновлення України відзначається, що їх впровадження повинно забезпечити реалізацію екологічної політики відповідно до євроінтеграційного напряму розвитку України та Європейського зеленого курсу. Зроблено висновок, що проголошені й закріплені на законодавчому рівні в довоєнний період основні засади і стратегічні цілі державної екологічної політики лишаються актуальними, особливо з урахуванням євроінтеграційних спрямувань нашої держави, а деякі з них в умовах війни набувають ще більшої гостроти. Однак, слід констатувати й актуалізацію інших цілей, які мають посісти важливе місце серед пріоритетних цілей державної екологічної політики й знайти відповідне нормативне закріплення, а саме: відшкодування шкоди, завданої довкіллю в умовах військової агресії; державної і грантової підтримки природоохоронних заходів в умовах війни і повоєнний період; подальшої цифровізації екологічних відносин; забезпечення сталого розвитку у повоєнний період. Доцільною є подальша розробка концептуальних правових засад щодо включення довкіллєвої безпекової складової до Стратегії повоєнного відновлення та розвитку України та відповідного Плану дій, а також секторальних програм щодо відновлення держави у спосіб формулювання відповідної кліматичної політики, узгодженої з подальшою європейською інтеграцією України з урахуванням Європейського зеленого курсу. The analysis of the program "Reconstruction of a clean and protected environment", which is a component of the project of the Recovery Plan of Ukraine, was carried out in the article. Five main directions of the state environmental policy, for the implementation of each of which the program provides for the implementation of a number of reforms, within the limits of which the relevant projects should be implemented, have been investigated. Analysis of the strategic goals, objectives, projects and measures of the national program "Reconstruction of a clean and protected environment" in the context of the recovery of Ukraine indicates that their implementation should ensure the implementation of environmental policy in accordance with the European integration direction of Ukraine's development and the European Green Course. It was concluded that the main principles and strategic goals of the state environmental policy, which were announced and fixed at the legislative level in the pre-war period, remain relevant, especially taking into account the European integration directions of our country, and some of them become even more acute in the conditions of the war. However, it is necessary to ascertain the actualization of other goals, which should occupy an important place among the priority goals of the state environmental policy and find the corresponding regulatory consolidation, namely: compensation for damage caused to the environment in conditions of military aggression; state and grant support for environmental protection measures in the war and post-war period; further digitization of environmental relations; ensuring sustainable development in the post-war period. Further development of conceptual legal frameworks for the inclusion of an environmental security component in the Strategy of post-war recovery and development of Ukraine and the corresponding Action Plan, as well as sectoral programs for the recovery of the state in the way of formulating an appropriate climate policy, coordinated with the further European integration of Ukraine, taking into account the European Green Course, is necessary.
