Зайняття іншою оплачуваною діяльністю як складова антикорупційної заборони

Abstract

Розглянуто проблемні аспекти тлумачення такої складової антикорупційної заборони несумісництва діяльності, пов'язаної з виконанням особою функцій держави або місцевого самоврядування, яка зайнята іншою оплачуваною діяльністю. З урахуванням результатів тлумачення та на підставі аналізу судових рішень запропоновано ознаки поняття "інша оплачувана діяльність" в антикорупційному законодавстві України. The problematic aspects of the interpretation of such a component of the anticorruption prohibition of incompatibility of activities related to the performance by a person of the functions of the state or local self-government as the occupation of another paid activity are considered. Taking into account the results of the interpretation and the analysis of judicial decisions, the signs of the concept “other paid activity” in the anti-corruption legislation of Ukraine are suggested.
