Законність у контексті профілактики правопорушень в службовій діяльності міліції України: дисертація

Abstract

Дисертація присвячена теоретичним і практичним питанням законності і дисципліни та профілактики правопорушень у службовій діяльності органів і підрозділів міліції України. Аналізуються сутність та зміст категорій законності і дисципліни як філософсько-теоретичних феноменів, діалектика їх взаємозв’язку, проблеми їх впливу у службовій діяльності працівників міліції. У дисертації проводиться комплексне наукове узагальнення впливів об’єктивних і суб’єктивних факторів та детермінант на порушення законності і дисципліни у службовій діяльності працівників міліції. Досліджується стан дисципліни та законності, роль профілактики, соціально-правовий захист працівників, а також кадрова політика, формування загальної та правової культури працівників міліції. Обґрунтовуються положення, що у забезпеченні правопорядку працівниками міліції важливе значення має громадська думка, зв’язок міліції з населенням і ЗМІ, що сприяє створенню якісно нової основи зміцнення службово-професійного і морально-психологічного потенціалу правоохоронців, недопущенню правопорушень серед працівників, спрямуванню їх роботи на забезпечення законності і дисципліни у службовій діяльності. Дисертація має практичне значення для вдосконалення профілактики правопорушень у службовій діяльності міліції України, виховної, соціально-психологічної роботи в органах і підрозділах міліції України. The dissertation deals with the theoretical and practical problems of legality and discipline and the measures for the prevention of offences in the official activities of the organs and subdivisions of the militia of Ukraine. The essence and the contents of the categories of legality and discipline as the philosophical-theoretical phenomena, the dialectics of their correlation, and the problems of their influence in the official activities of the militiamen are analysed. The complex scientific generalization of the influence of the objective and subjective factors and the determinants on the legality and discipline offences in the official activities of the militiamen is carried out in the dissertation. The state of legality and discipline, the role of the preventive measures, the social and legal protection of the militiamen, the personnel policy, and the formation of the general and legal culture of the militiamen are studied. The statement, that the public opinion, the connection of the militia with the public and mass media is of great importance in the law enforcement by the militiamen, is stated. They assist in the creation of the qualitatively new basis of the strengthening of the service-professional and moral-psychological potential of the law enforcements officers, the exclusion of offences among the militiamen, the direction of their activities on the law and discipline enforcement in their official activities. The dissertation has practical value for the improvement of the measures for the prevention of offences in the official activities of the militia of Ukraine, for the educational, social-psychological work in the organs and subdivisions of the militia of Ukraine.
