Формування та розвиток ідеї гуманізму в праві: філософсько-правовий вимір: дисертація

Abstract

Філософсько-правове розуміння формування та розвитку ідеї гуманізму в праві осмислено на фоні становлення і розвитку філософсько-правової думки, в контексті різних інтерпретацій гуманізму з урахуванням історичних особливостей еволюції права та акцентуванні на сутнісних характеристиках гуманізму у праві. Гуманізм у праві розглядається як система світоглядних соціально-правових цінностей, антропологічною основою яких є людська гідність, яка виявляється в основних правах та свободах людини і знаходить своє закріплення у правових принципах і нормах. Формування базових гуманістичних детермінант поведінки людини зумовлене особливостями буття людей, метою моделювання і підтримання соціально корисних відносин. Такими засобами є соціальні та правові норми, які формують правила поведінки людини, закріплюючи базові гуманістичні цінності і принципи. В такому розумінні гуманізм є необхідною умовою нормального існування суспільства і держави, вихідною засадою формування соціальних норм, а головне – ідеологічною основою формування і розвитку права.Philosophical and legal understanding of the formation and development of ideas of humanism in law interpreted against the background of the formation and development of philosophical and legal thought in the context of different interpretations of humanism with regard to historical features of the evolution of law and its focus on the essential characteristics of humanism in the Law. Humanism in the law is considered as a philosophical system of social and legal values, which the20 anthropological foundation of human dignity, which is manifested in the fundamental rights and freedoms of man and finds its consolidation in the legal principles and norms. Formation of basic humanistic determinants of human behavior caused by the peculiarities human being and aims modeling and maintainance healthy social relationships. These tools are social and legal norms that are forming the rules of human behavior, consolidating basic humanistic values and principles. In this sense humanism is essential for the normal existence of society and state, the original principle of formation of social norms, and most importantly, the ideological basis for the formation and development of law.
