Акцентовано, що господарський суд оцінює докази за своїм внутрішнім переконанням, що ґрунтується на всебічному, повному й об'єктивному розгляді в судовому процесі всіх обставин справи в їх сукупності, керуючись законом. Підкреслено те, що оцінка доказів, це розумова, логічна діяльність, яка приводить до висновків щодо допустимості, належності, достатності кожного доказу по справі для наступного формулювання висновків та постановлення рішень. Суд оцінює докази за своїм внутрішнім переконанням, що ґрунтується на всебічному, повному й об'єктивному розгляді всіх обставин справи в їх сукупності, керуючись законом.
