Abstract

Статтю присвячено дослідженню правових аспектів зміни способу та порядку виконання рішень господарського суду. Запропоновано розмежовування способу та порядку виконання рішення господарського суду як родове та видове поняття. Досліджено підстави зміни способу й порядку виконання рішення господарського суду. Проаналізовано основні напрями використання зарубіжного досвіду встановлення та зміни способу й порядку виконання рішення господарського суду. The article studies the legal aspects of changing the method and procedure of enforcement of commercial court. Therefore, the state must ensure the full enforcement of the judgment, and this requires the creation of certain conditions, organizational, managerial, procedural and informational nature. The most important prerequisite for the full and proper execution of court decisions, is a method and procedure implementation, defined in the decision of the court. In the absence of clarity in the way and manner of implementation of any, even the most fair decision can not be implemented in practice. The study legal aspects of changing the method of enforcement and Commercial Court carried out such scholars as V.I. Yevintov, A.V. Isayenkova,E.V. Maltsev, R.V. Myronyuk, their work is devoted to research of international experience enforcement of judgments; V. Petrov, it was investigated the problem of determining the nature and characteristics of the procedure of establishing and changing the method of execution of economic court considering the need to improve economic and procedural law and efficiency of judicial protection of participants of economic relations; I.E. Berestova, investigated the nature of procedural changes or installation method and order execution; Talina Kravtsova special attention in his work pays study and characterization of conditions and procedures for enforcement of commercial courts.
