Правова культура як елемент ефективності заохочувальних норм у процесі розвитку правової політики держави

Abstract

Метою статті є дослідження проблеми розвитку правової політики держави крізь призму правової культури як елементу ефективності заохочувальних норм. У статті досліджено проблеми розвитку правової політики держави крізь призму правової культури як елементу ефективності заохочувальних норм. Зазначено, що правова культура особистості формується під впливом різних чинників, таких як діяльність засобів масової інформації з поширення правових знань, діяльність правоохоронних органів щодо припинення порушення норм чинного права, виховання у громадян почуття непримиренності до різного роду правопорушень, а також активне застосування в цій сфері методів переконання і заохочення тощо. Правова культура визначається як сукупність досягнень суспільства, його соціальних груп і громадян у царині регулювання суспільних відносин, що забезпечує верховенство права суспільного життя, – планування в суспільному житті правових принципів справедливості і гуманізму, захисту прав і свобод людини, її честі й гідності, реальне забезпечення місця людини як вищої соціальної цінності. Наголошено, що формування правової культури особистості – складний процес, який не стоїть на одному місці. У ньому відбуваються суттєві зміни під впливом змін повсякденного життя людей, зростання рівня їхньої освіти, задоволення людиною своїх матеріальних і духовних потреб, набуття нею громадянської зрілості. Завдяки засобам масової інформації і щоденному спілкуванню дедалі тіснішими стають контакти між державою й особою, що сприяє взаємному дотриманню правових норм, показником яких слугує зростання правової культури. Натомість порушення чинного законодавства тягне за собою застосування заходів державного примусу. Не меншу роль правомірної їх реалізації відіграє заохочення. Правове заохочення – це та основа, на якій має ґрунтуватися виконання гуманітарних зобов’язань правової держави щодо поваги й дотримання прав людини. Заохочення як правовий стимул впливає на формування правомірної мотивації. Зроблено висновок, що правове заохочення розглядається в контексті цінності для людини, утвердження її як автономної особистості. It is noted that the legal culture of an individual is formed under the influence of various factors, such as the activity of the mass media on the dissemination of legal knowledge, the activity of law enforcement agencies regarding the cessation of violations of the norms of the current law, the education of citizens’ sense of intolerance to various types of offenses, as well as active application in this area methods of persuasion and encouragement, etc. Legal culture is defned as a set of achievements of society, its social groups and citizens in the feld of regulation of social relations, which ensures the supremacy of law in public life, planning in public life legal principles of justice and humanism, protection of human rights and freedoms, honor and dignity, real provision the place of a person as the highest social value. It is emphasized that the formation of the legal culture of an individual is a complex process that does not stand in one place. Signifcant changes are taking place in it under the influence of changes in people’s everyday life, an increase in the level of their education, a person’s satisfaction of his material and spiritual needs, and his acquisition of civic maturity. Thanks to the mass media and daily communication, contacts between the state and the individual are becoming closer and closer, which contributes to mutual compliance with legal norms, which is an indicator of the growth of legal culture. Instead, violation of current legislation entails the application of state coercive measures. Encouragement plays an equally important role in their legitimate implementation. Legal encouragement is the basis on which the fulfllment of the humanitarian obligations of the legal state to respect and observe human rights should be based. Encouragement as a legal incentive affects the formation of legitimate motivation.
