Право на інформаційну безпеку як складова права людини на безпеку: концептуальні положення захисту інформаційних прав

Abstract

У статті досліджено право на інформаційну безпеку як складову права людини на безпеку крізь призму захисту інформаційних прав. Зазначено, що права людини можуть бути забезпечені лише при досягненні стану національної безпеки. Саме тому забезпечення безпеки людини вимагає запобігання і припинення загроз національній безпеці, тероризму, насильству і злочинності. Важливе значення має також забезпечення конфіденційності персональних даних та захисту інформації про особисте життя від незаконного доступу й використання. Безумовно, безпека особистості є фундаментальним правом кожної людини і потребує загального захисту й уваги з боку держави і суспільства. Особливо гостро це питання стоїть в умовах тотальної загрози миру і безпеці з боку загарбницький дій РФ. Наголошено, що захист інформаційної безпеки людини передбачає не тільки захист від кібератак і витоку особистих даних, а й урахування впливу інформації на фізичний і психічний стан людини, а також на її моральні й духовні цінності. Визначення інформаційної безпеки особистості в такому контексті дає змогу більш повно врахувати всі можливі загрози і ризики, які можуть виникнути під час використання інформаційних технологій. Важливо не тільки захищати особисті дані, а й забезпечувати безпечне й етично правильне використання інформації, яка може завдати шкоди здоров’ю та розвитку особистості. Такий підхід допоможе створити більш гармонійний і безпечний інформаційний простір для кожної людини. Зроблено висновок, що право особи на інформаційну безпеку є одним з основних прав, яке гарантує захист особистої інформації в інформаційному суспільстві. Воно надає можливість людині самостійно регулювати доступ до своїх персональних даних, контролювати їх використання й поширення. Одним з першочергових завдань вітчизняного законодавця має стати пошук дієвих механізмів захисту інформаційних прав і свобод, які є основою права людини на безпеку. Саме існування електронної держави має давати можливість суб’єктам інформаційних відносин захистити свої права й інтереси. При реалізації інформаційних прав і свобод важливо, якою мірою галузеве законодавство відповідає реаліям суспільних відносин у цій сфері. Зрештою, інформаційне право має прагнути такого рівня свого розвитку, коли про конкретні інформаційні права можна судити по закріплених галузевим законодавством гарантіях їх здійснення. The article examines the right to information security as a component of the human right to security through the prism of protection of information rights. It is noted that human rights can be ensured only when the state of national security is achieved. That is why ensuring human security requires preventing and stopping threats to national security, terrorism, violence and crime. It is also important to ensure the confdentiality of personal data and the protection of information about personal life from illegal access and use. Undoubtedly, personal safety is a fundamental right of every person and requires general protection and attention from the state and society. This issue is especially acute in the conditions of a total threat to peace and security from the aggressive actions of the Russian Federation. It was emphasized that protecting a person’s information security involves not only protection against cyberattacks and leakage of personal data, but also taking into account the impact of information on a person’s physical and mental state, as well as on his moral and spiritual values. Defning the information security of an individual in this context makes it possible to more fully take into account all possible threats and risks that may arise during the use of information technologies. It is important not only to protect personal data, but also to ensure the safe and ethical use of information that can harm the health and development of a person. This approach will help create a more harmonious and safe information space for every person. It was concluded that a person’s right to information security is one of the basic rights that guarantees the protection of personal information in the information society. It provides an opportunity for a person to independently regulate access to their personal data, control their use and distribution. One of the primary tasks of the domestic legislator should be the search for effective mechanisms for the protection of informational rights and freedoms, which are the basis of the human right to security. The very existence of the electronic state should enable subjects of information relations to protect their rights and interests. When implementing informational rights and freedoms, it is important to what extent industry legislation corresponds to the realities of social relations in this area. In the end, information law should strive for such a level of its development, when specifc information rights can be judged by the guarantees of their implementation established by industry legislation.
