Визначення правової політики держави в контексті заохочувальних норм права та правової культури особи

Abstract

Стаття присвячена визначенню правової політики держави в контексті заохочувальних норм права та правової культури особи. Зазначено, що шлях, який обрала Україна, рухаючись до побудови правової, демократичної і соціальної держави, нерозривно пов’язаний з формуванням правової політики, як складової державної політики. Саме правова політика, покликана закласти відповідне підґрунтя для створення та застосування норм права, започаткування стратегії і тактики розвитку належної правової системи, яка спрямована на адаптацію норм права, що містять світові стандарти перевірені часом, насамперед, у сфері захисту прав, свобод та інтересів людини і громадянина. Підкреслено, що така правова політика також повинна ґрунтуватись і на кращих традиціях українського народу, його культурній спадщині, яку потрібно розвивати та примножувати. Натомість, варто розуміти, що правова політика є багатовимірною категорією, яка включає не лише правовий аспект, а й безпосередньо і тісно пов’язана з політикою, економікою, соціальною сферою, публічною діяльністю та відповідальністю органів влади, громадянським суспільством тощо. Отож, в умовах, яких нині знаходиться наша держава, формування належної правової політики становить важливий пріоритет, з огляду на європейський вектор розвитку України. Зроблено висновок про те, що правова політика є тим універсальним інструментом і комплексним засобом, що дозволяє ефективно захищати та гарантувати права і свободи людини і громадянина. Водночас, для реалізації правової політики важливим є досягнення належного рівня правової культури особи, що складає цілісну правову культуру суспільства. Належний рівень правового виховання, а також прийняття норм, які заохочують правомірну поведінку, вочевидь, є тими чинниками, які слугують каталізаторами правової політики, що реалізується державою. The article is devoted to the defnition of the legal policy of the state in the context of encouraging norms of law and the legal culture of the individual. It is noted that the path chosen by Ukraine, moving towards the construction of a legal, democratic and social state, is inextricably linked with the formation of legal policy as a component of state policy. It is the legal policy, which is designed to lay the appropriate foundation for the creation and application of legal norms, the initiation of strategies and tactics for the development of an appropriate legal system, which is aimed at adapting legal norms containing time-tested world standards, primarily in the feld of protection of human rights, freedoms and interests and citizen It is emphasized that such a legal policy should also be based on the best traditions of the Ukrainian people, its cultural heritage, which needs to be developed and multiplied. Instead, it is worth understanding that legal policy is a multidimensional category that includes not only the legal aspect, but is also directly and closely related to politics, economy, social sphere, public activity and responsibility of authorities, civil society, etc. Therefore, in the conditions in which our state is now, the formation of an appropriate legal policy is an important priority, given the European vector of Ukraine’s development. It was concluded that the legal policy is the universal tool and complex means that allows to effectively protect and guarantee the rights and freedoms of a person and a citizen. At the same time, for the implementation of legal policy, it is important to achieve the appropriate level of legal culture of an individual, which constitutes the integral legal culture of society. The appropriate level of legal education, as well as the adoption of norms that encourage lawful behavior, are obviously the factors that serve as catalysts for the legal policy implemented by the state.
