Оніми в англійському законодавчому дискурсі (на прикладі правової системи Великобританії)

Abstract

У статті досліджуються семантичні характеристики та особливості функціонування термінів з онімічними компонентами у правовій системі Великобританії, що має не лише теоретичне, але й практичне значення для викладання як юридичних дисциплін, так і філологічних, зокрема навчання іноземної мови. Наголошується, що аналіз використання онімів в англійському законодавчому дискурсі вимагає встановлення співвідношення, взаємозв’язку між онімами та термінами, в яких вони вживаються. Охарактеризовано юридичний дискурс, що є процесом інформаційної дії суб’єктів права в сфері правового спілкування, а також його підвид законодавчий дискурс, що стосується нормативно правових актів (законодавчих і підзаконних нормативних актів), прийнятих законодавчим органом, що діють на території держави, регулюють взаємовідносини між громадянами та державою та регулюють певну сферу суспільних відносин. Проаналізовано онімічні терміни, які відображають соціо-культурні, національно-культурні та національно-правові особливості певного суспільства, оскільки власні назви в структурі терміна є носіями культурно-історичної інформації. Лексичні одиниці мови права відображають культурний зміст національних правових концептів, і це відображається в понятійному апараті правознавства. Підкреслено, що назви з компонентом-онімом, що використовуються в англійському законодавчому дискурсі, який є середовищем, що має прецедентний характер способу творення законодавства, відображають суттєвий внесок юридичного співтовариства у розвиток правової системи Великобританії та є значним пластом у юридичній термінології. Перспективними видаються порівняльні дослідження семантики, функціонування та структури термінів з онімічними одиницями в англійському, американському та українському законодавчому дискурсах. The article deals with the semantic characteristics and peculiarities of functioning of the terms with the onymic components in the legal system of Great Britain that has not only the theoretical, but also the practical importance for teaching both legal and philological disciplines, particularly for teaching a foreign language. It is underlined that the analysis of using the onyms in the English legislative discourse demands to establish the relationship and interconnection between the onyms and terms in which they are used. The legal discourse which is a process of the information action of the subjects of law in the sphere of legal communication, and also its subspecies the legislative discourse that pertains to the normative legal acts (legislative acts and subordinate legislation) adopted by a legislative organ, which act on the territory of the state, regulate the interactions between the citizens and the state and regulate a certain sphere of the public interactions are characterized. The onymic terms, that reflect the sociocultural, national-cultural and national-legal peculiarities of a certain society, because the proper names in the structure of a term are the carriers of the cultural and historical information, are analysed. The lexical units of the language of law reflect the cultural content of the national legal concepts, and it is reflected in the conceptual apparatus of jurisprudence. It is stated that the names with the component-onym that are used in the English legislative discourse, which is the medium that has a precedent character of the means of forming legislation, reflect the essential contribution of the legal community into the development of the legal system of Great Britain and is a significant intercalation in the legal terminology. Conducting the comparative research of the semantics, functioning and structure of the terms having the onymic units in the English, American and Ukrainian legislative discourses seems to be perspective.
