Рівність суб’єктів права та заборона дискримінації: до питання про співвідношення принципі

Abstract

Стаття присвячена деяким аспектам співвідношення принципів рівності та заборони дискримінації Обгрунтовується, що принцип заборони дискримінації має самостійне значення і не може бути зведений до будь кого порушення принципу рівності. Аналізуються національне та міжнародні визначення дискримінації. Робиться висновок про частково релятивний оціночний характер принципів юридичної рівності та заборони дискримінації. The article is devoted to some aspects of the relationship between the principles of equality and the prohibition of discrimination. It is justified that the principle of the prohibition of discrimination has an independent meaning and cannot be reduced to any violation of the principle of equality. National and international definitions of discrimination are analyzed. A conclusion is made about the partly relative evaluative nature of the principles of legal equality and the prohibition of discrimination.
