Проблеми розвитку адміністративно-правового статусу Командувача Національної гвардії України

Abstract

Метою статті є уточнення поняття та особливостей розвитку адміністративно-правового статусу Командувача Національної гвардії України. Проаналізовано розвиток законодавства, яким регулювався правовий статус Національної гвардії України та внутрішніх військ Міністерство внутрішніх справ України. З'ясовано, що тенденції, притаманні розвитку правового статусу Командувача Національної гвардії України, характеризуються його деталізацією, що стає наслідком реформування всієї системи публічної влади відповідно до демократичних стандартів. Констатовано наявність прогалин, пов'язаних з недостатньою відкритістю Національної гвардії України для громадського погляду. The purpose of the article is to clarify the concept and features of the development of the administrative and legal status of the Commander of the National Guard of Ukraine. The administrative-legal status of the Commander of the National Guard of Ukraine is defined as a set of legal means determined by the norms of administrative law, with the help of which the specified official exercises his competence. The structure of the administrativelegal status of the Commander of the National Guard of Ukraine is determined by its integral components necessary for the performance of functions and powers defined by law. As elements of this structure, one should consider the rights, obligations, guarantees of activity, as well as the specifics of the interaction of the Commander of the National Guard of Ukraine with the President of Ukraine, the Verkhovna Rada of Ukraine, the Commander-in-Chief of the Armed Forces of Ukraine, the Minister of Internal Affairs of Ukraine, as well as other subjects of the security and defense sector defined by law The tendencies characteristic for the development of the legal status of the Commander of the National Guard of Ukraine are characterized by its specification, which is the result of reforming the entire system of public authority in accordance with democratic standards. The movement from the principle of “manual control” to the establishment in the activities of the National Guard of the principle of legal certainty of the competence of the Commander indicates the approximation of legislation in the area under study to democratic standards. At the same time, it can be stated that there are gaps associated with the insufficient openness of the National Guard of Ukraine and its commander for control and public oversight. Thus, there are no forms of public reporting of the Commander to the public, and the features of interaction with representatives of public society are not defined. These problems determine the vectors for the development of legislation regulating the legal status of the Commander of the National Guard of Ukraine.
