Функції превенції фінансової відповідальності

Abstract

У статті на підставі комплексного підходу та системного аналізу чинного законодавства, у контексті європейської інтеграції України, розглянуто функції превенції фінансової відповідальності. Об’єктом дослідження виступають суспільні відносини, що піддаються превентивному впливу фінансової відповідальності. Предметом дослідження є функції превенції фінансової відповідальності. Превентивна функція фінансової відповідальності – це напрям правового впливу норм юридичної відповідальності на поведінку суб’єктів суспільних відносин, що полягає у запобіганні правопорушенням у фінансовій сфері держави. In the article, based on a comprehensive approach and systematic analysis of the current legislation, in the context of the European integration of Ukraine, the functions of the prevention of financial responsibility are considered. The object of research is social relations that are subject to the preventive influence of financial responsibility. The subject of the study is the legal norms that determine the preventive function of financial responsibility. The preventive function of financial responsibility is the direction of the legal influence of the norms of legal responsibility on the behavior of subjects of public relations, which consists in preventing offenses in the financial sphere of the state. The preventive function is a multi‐ structural education characterized by many structures. The logical structure of the preventive function of financial responsibility includes objects of action, subjects of action; methods of action; the basis of influence. The structure of the preventive function at the micro level of the system of legal responsibility consists of the preventive functions of individual branch types of legal responsibility, and at the macro level, the preventive function of procedural and material responsibility. At the elemental level, the structure of the preventive function includes: prevention based on the norms of financial responsibility, duties, prohibitions, permits, sanctions, condemnation, and actual application of measures of legal responsibility. Depending on the subjects and methods of influence, the structure of the preventive function includes private preventive influence and general preventive influence. Public relations are the objects of influence of the preventive function of financial responsibility. The impact on social relations occurs through a number of intermediate objects. The specific list of objects of preventive function depends on the subject of regulation of the branch institute of financial responsibility. Prevention of violations in financial varieties of social relations is carried out comprehensively with the help of preventive functions of several types of legal responsibility at once.
