Інформаційна приватність та її захист від злочинних посягань в Україні: монографія

Abstract

Проведено комплексне дослідження кримінально-правової охорони інформаційної приватності в Україні. Розкритий зміст і обсяг поняття інформаційної приватності, проаналізований історичний та зарубіжний досвід кримінально-правової охорони інформаційної приватності, здійснено розмежування складів злочинів, що посягають на інформаційну приватність з іншими посяганнями, предметом яких є інформація про особу. У процесі дослідження практики Європейського суду з прав людини визначено межі права на інформаційну приватність, проаналізовано підстави доступу до приватної інформації та регламентації такої інформації в національному законодавстві. На основі дослідження об’єктивних та суб’єктивних ознак складів злочинів, що посягають на інформаційну приватність, обґрунтовується необхідність вдосконалення законодавчої регламентації відповідальності за відповідні посягання. Для студентів, аспірантів, викладачів юридичних вищих закладів освіти, а також працівників правоохоронних органів та суддів. The complex scientific research of the problems of criminal and legal protection of informative aspect of privacy in Ukraine was carried out. The author’s determination of the concept of privacy (in an informative aspect) is offered, the definition of other concepts such as «correspondence», «violation of secret of correspondence» is developed. Historical and foreign experience of criminal and legal protection of privacy is considered. The judicial analysis of indicia of these offenses and sanctions for their commission is made as well as the problems of criminal and legal qualification are reviewed. The legal occurrences of admission to information with the limited access about a person are formulated. In the process of studying the practice of the European Court of Human Rights, the limits of the right to information privacy have been determined, the grounds for access to private information and the regulation of such information in the national legislation have been analyzed. For students, graduate students, teachers of higher educational institutions of law, as well as law enforcement officers and judges.
