Правові основи забезпечення транспортної безпеки в діяльності національної поліції

Abstract

Досліджено правові основи забезпечення транспортної безпеки в діяльності Національної поліції. На підставі застосування методології теорії систем розглянуто особливості правого регулювання забезпечення транс- портної безпеки та безпеки транспортної інфраструктури, роль і місце Національної поліції у визначеній сфері в умовах європейської інтеграції та окреслено комплекс питань, які потребують правого регулювання у контексті агресії на сході держави. The article deals with the research of the legal principles of ensuring transport security in the activities of the National Police. The peculiarities of the legal regulation of ensuring transport safety and security of the transport infrastructure, the role and place of the National Police in the context of the European integration are considered on the basis of applying the methodology of the systems theory. The complex of issues that need legal regulation in the context of aggression in the east of the state is determined. The National Security Strategy of Ukraine provides an institutional system for ensuring transport security, involving various bodies of state power and administration, enterprises operating various types of transport. It should be emphasized that the issue of ensuring transport safety, being logically interrelated with other problems of ensuring social security, cannot be excluded from the general context of ensuring the national security. The police take an important role among the subjects that provide the transport security and the operation of the transport infrastructure. Despite the fact that the police carry out only a part of the activities in the provision of transport security, the coordination and efficiency of the whole system of ensuring transport security depend on its operation. Despite the positive indices of the police activities in ensuring transport security, there are legal and organizational problems that need to be solved. Improving the legal regulation of police activities in the field of transport security should take into account the specifics of the functioning of transport. Improving the quality of the work of the National Police in this sphere depends on its organizational structure, which should take into account a number of circumstances. In particular, the police structure serving the transport sector should cover the central and territorial level of the functioning of the kind of transport, the level of the corresponding transport node.
