Повноваження національного агентства з питань запобігання корупції

Abstract

Проаналізовано повноваження Національного агентства з питань запобігання корупції в контексті чинного антикорупційного законодавства. Аргументовано необхідність проведення Національним агентством з питань запобігання корупції роз’яснювальної та методичної роботи з проблемних питань застосування актів законодавства стосовно етичної поведінки, запобігання та врегулювання конфлікту інтересів у діяльності осіб, уповноважених на виконання функцій держави або місцевого самоврядування. Визначено категорії суб’єктів, з якими Національне агентство з питань запобігання корупції має проводити підготовку, перепідготовку й підвищення кваліфікації з питань, пов’язаних із запобіганням корупції. The powers of the National Agency for the Prevention of Corruption (NAPC) in the context of the current anti-corruption legislation are analyzed. The necessity of explanatory and methodical work on problematic issues of application of legislation on ethical issues, prevention and settlement of conflicts of interest in the activities of persons authorized to perform state or local government functions by the National Agency for the Prevention of Corruption was proved. The foundation of the national system for assessing the level of corruption should be the annual basic thematic sample survey of the people and business representatives, complemented by experts’ surveys on a separate toolbox. The categories of subjects with which the NAPC is to carry out training, retraining and advanced training on issues related to the prevention of corruption are defined. It was concluded that an important step in preventing corruption was the introduction of electronic declaration of persons authorized to perform functions of the state or local self-government. Since the NAPC carries out the maintenance of the Unified State Register of Declarations, it is this body that controls and verifies the declarations of persons authorized to perform functions of the state or local selfgovernment. It is substantiated that effective implementation of anti-corruption programs of legal entities will ensure transparency of their activities, fair and impartial performance of employees and management of legal entities of their functional duties, which will not only save state funds but also monitor their use by a legal entity. It is argued that NAPC should systematically conduct explanatory and methodical work on problematic issues of application of legislation on ethical issues, prevention and settlement of conflicts of interest in the activities of persons authorized to perform functions of the state or local self-government. It is concluded that the current legislation gives the NAPC sufficient capacity for the implementation of its functions, but the agency’s tasks will be fully realized only if there is no political influence on the process of selecting the members of the NAPC and in the exercise of their powers
