Синергетика як методологічна парадигма юридичних досліджень

Abstract

Розглянуто синергетичний підхід до дослідження права та правових явищ як одну з можливих методологій їх аналізу. Акцентовано на сутнісних характеристиках синергетичної методології, головна з яких полягає у формуванні потреби і пошуку можливостей саморегуляції суспільного життя та його правового впорядкування. Запропоновано розглядати синергетику як під-хід до дослідження права, що наділений методологічними можливостями відкриття внутрішніх механізмів самоорганізації права як системи й ствердження конструктивних напрямів її подальшого розвитку. In current studies of law and legal reality, synergetics is mostly presented as a general methodology that has not received sufficient confirmation or final refutation and, accordingly, remains controversial. Therefore, the authors set out to describe the general idea of the synergetic paradigm and determine its place and role in the science of law as a specific system of research methods, that is, methodology that can not claim to be of general status. The article deals with the synergetic approach to the study of law and legal phenomena as one of the possible methodologies for its analysis. Great attention is paid to the essential characteristics of synergetic methodology, the main of which provides the formation of the need and the search for opportunities for self-regulation of social life and its legal maintenance. The authors proposed to consider synergetics as an approach to the study of law, endowed with methodological opportunities to reveal internal mechanisms of self-organization of law as a system and approval of constructive ways for its further development. It is singled out that the synergetics focuses on the development of the system of law, indicating its output from the state of entropy at the break of social epochs, which is manifested in the transitivity of most social institutions, values and norms, and, consequently, leads to the emergence of new social structures and causes changes in the organization of society management. The authors prove that synergetics can provide the study of law by mechanisms of spontaneous formation and preservation of complex systems, in particular those in a state of unstable equilibrium with the external environment, requiring stability support and are capable of self-organization. It is in this capacity that synergetics enriches dialectics as the most general methodology for the study of any phenomena, including legal reality.
