Основні форми та методи діяльності поліції у сфері забезпечення конституційних прав і свобод людини та громадянина України

Abstract

Присвячено дослідженню форм і методів діяльності поліції у сфері забезпечення конституційних прав і свобод людини та громадянина в Україні. Проаналізовано юридичну сутність форм і методів діяльності поліції у контексті Закону України «Про Національну поліцію». Розглянуто класифікацію форм і методів діяльності поліції та вплив на стан захищеності прав і свобод людини на тлі реформування правоохоронної системи держави. The problem of promoting constitutional rights and freedoms of man and citizen takes a special place at the stage of the association of Ukraine and EU. This approach is demonstrated in the current Constitution of Ukraine, which proclaimed the priority of general human values over all other values of the State and society. In terms of Association Agreement this course is especially useful, because today the constitutional rights and freedoms are at the heart of Government policy. Police use special forms and methods in ensuring the constitutional rights and freedoms of man and citizen. These forms and methods of the police activity should be adequate to real needs of protection of the rights and freedoms of man and citizen. In this regard, the problem of creating the forms and methods of the activity of police officers in the system ‘police-civil society’defines the necessity of theoreticalmethodological interpretation of the state and prospects of the development of forms and methods of police activity to ensure the constitutional rights and freedoms of man and citizen in Ukraine. The characteristic feature of the validity of the European police is forming the forms and methods of activity aimed at participation, mutual assistance, confidence, tolerance, compromise, publicity, where agreement and conciliation procedures are crucial parameters. Moving to qualitative, constructive development of forms and methods of the police activity to ensure the constitutional rights and freedoms is possible only when the need for interaction between the police and institutions of civil society will become the axiom for them. Therefore, it is necessary to determine the main directions of the development of the forms and methods of the police activity, to study the influence of processes of interaction of police and institutions of civil society not only to ensure stability, controllability, but also its innovative breakthrough. At the same time qualitative updating essential foundations of the forms and methods of police activity to ensure the constitutional rights and freedoms of man and citizen is an extremely important direction of the transformations of modern Ukraine.
