Єдиний державний реєстр юридичних осіб, фізичних осіб-підприємців та громадських формувань як засіб організації господарських правовідносин

Abstract

Розглянуто положення, порядок формування, використання і значення відомостей Єдиного державного реєстру юридичних осіб, структурних підрозділів, громадян-підприємців та громадських формувань. Зазначено, що його відомості формуються на підставі заяв про державну реєстрацію; документів, які є обов’язковими для проведення реєстраційних дій; відомостей, отриманих у результаті інформаційної взаємодії між Єдиним державним реєстром юридичних осіб, структурних підрозділів, громадян-підприємців та громадських формувань й інформаційними системами державних органів. Вказано, що він ведеться державною мовою з використанням програмного забезпечення на електронних носіях відповідно до державних стандартів у контексті вимог директив Ради Європи, що забезпечує його взаємодію з іншими інформаційними системами та мережами. На основі аналізу відомостей Єдиного державного реєстру юридичних осіб, структурних підрозділів, громадян-підприємців та громадських формувань зроблено висновок про їх нормативно-правовий засіб забезпечення комунікативності в формуванні господарських правовідносин. The author considers the provisions, procedure of formation, use and signif-icance of information of the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations. Its data are formed on the basis of appli-cations for the state registration; documents that are required for the conduct of registration; information obtained as a result of informational interaction between the Unified State Register and information systems of state authorities. The registry is conducted in the state language using software on electronic media in accordance with the state standards in the context of the requirements of the di-rectives of the Council of Europe, which provides its interaction with other infor-mation systems and networks. The author has made a conclusion about the normative and legal means of providing communication in the formation of economic legal relations based on the analysis of the data. They are generally one of the legal forms of coordination of the activities of participants in the economic turnover. Creation of a harmonic and an effective system of the economic legislation of Ukraine under modern circumstances requires its adaptation to the European system of conducting business and creating favorable conditions for the organization and conduct of business, the protection of the rights and legitimate interests in economic legal relations with other entities and authorities. The state carries out a long-term (strategic) policy aimed at implemen-tation and optimal coordination of the interests of businesses subjects and consum-ers of the various strata of the population in general. A prerequisite for coordination of their interests is full and reliable data of the Unified State Register of Legal Enti-ties, Individual Entrepreneurs and Public Organizations. For example, the following data include the beginning and conditions of creation, founders, organizational and legal form, economic activity and its legitimacy, competence, the head and members of the governing bodies of legal entities, etc.
