Проект нових положень законодавчого урегулювання оперативно-розшукової діяльності

Abstract

Запропоновано основні положення до проекту Закону України «Про оперативно-розшукову діяльність», які безпосередньо урегульовують проведення оперативно-пошукових та оперативно-розшукових заходів. Акцентовано на необхідності законодавчого визначення поняття та змісту оперативно-розшукових заходів, поняття, змісту й переліку заходів оперативного пошуку з метою виконання конкретних завдань оперативно-розшукової діяльності до початку оперативної розробки за оперативно-розшуковою справою. Запропоновано новий перелік оперативно-розшукових заходів. Today law enforcement system represented by subjects of operative investigation activity needs a law with specific efficient instruments, which are clear to the citizens, against modern intelligent organized crime with links of corruption which has long been familiar with means, forces, methods, operations and forms of law enforcement activities. The main provisions to the project of the Law of Ukraine «On operative investigation activity» which directly regulate a conduct of operative search and operative investigative operations have been provided. The focus has been made on necessity of statutory definition of concept and content of operative investigative operations, concept, content and list of operations of operative search aiming to perform particular tasks of operative investigation activity prior to criminal intelligence analysis on operative investigation case. New list of operative investigative operations has been provided. Statutory definition of concepts of force and means of operative investigation activity has been formed, concept and purpose of operative investigation activity have been clarified, organizational framework of its conducting has been described. The content of public operations of operative investigation activity has been revealed.
