Окремі аспекти підвищення ефективності норм адміністративного права у період адаптації законодавства до вимог Європейського Союзу

Abstract

Присвячено питанням дослідження напрямів підвищення ефективності адміністративного права у період адаптації національного законодавства до вимог Європейського Союзу в контексті механізму правового регулювання. Розглядається досвід європейських країн щодо вибору критеріїв ефективності, об’єктивних чинників, які впливають на результативність застосування правових норм, засобів і методів галузевого регулювання, спрямованих на підвищення дієвості норм права. The article deals with the investigation of ways of increasing the efficiency of administrative law in the period of adaptation of national legislation to EU requirements in the context of the mechanism of legal regulation. We consider the European experience regarding the factors that affect the efficiency of the rules of law. When adapting national legislation to European one, inefficiency of means and methods of legal regulation, and as a result – an ineffective action of law occurs due to the fact that the mechanism of the law applying in a particular branch is not always taken into account in the building of a system of sectoral regulation. The universal nature of the mechanism of legal regulation in the context of administrative law finds its adequate expression, gradually taking place in a specific sectoral system that has an impact on other branches of law. The emergence of new sectures of regulation (information law) complicates the situation of applying universal mechanism of legal regulation where purposeful action of organizing mechanism inevitably leads to strengthening legal component, including areas for which the regulation is not the most significant. In terms of adaptation of national legislation with EU requirements, providing effective legal regulation is only possible under fundamentally new approaches to its organization, excluding socio-economic realities but taking into account the objective differences existing mechanisms of law. This problem requires theoretical understanding of the components of administrative law: financial, tax, budget, information. When choosing legal means to adapt national legislation to the requirements of the EU, it is reasonable to take into account the experience of Poland that in the process of legal regulation we use two directions – forecasting and modeling.
