Використання інформації, отриманої із застосуванням інформаційно-комунікаційних технологій, як доказ у справі про адміністративне правопорушення

Abstract

Присвячено дослідженню інформації, отриманої із застосуванням інформаційно-комунікаційних технологій, яка може використовуватися як доказ у справі про адміністративне правопорушення. Охарактеризовано особливості електронних джерел доказів і засобів забезпечення доказових фактів, одержаних із них, можливість безпосереднього дослідження джерел доказової інформації. The article deals with the information obtained with the use of ICT (information and communication technologies) that can be used as evidence in the case of the administrative offence. The characteristics of electronic sources of evidence and means of ensuring evidentiary facts, the ability to research evidence of information sources are analyzed. Current priorities of the state development caused by the computerization of the society contribute to the appearance of new aspects of the institution of administrative responsibility. The concept of applying information obtained with the use of information and communication technologies in the process of proof is based on the technological approach. In terms of philosophy, natural sciences and interdisciplinary researches there is a complex structure, within which it is advisable to distinguish three levels of studies: technical, technological, legal. The information obtained with the use of ICT is the information presented in electronic-digital form on a tangible medium created hardware and software facilities for recording, processing and transmission of information, a set of applications designed for use in computers, information and communication system, network and equipment management. The information obtained with the use of information and communication technologies as a form of evidence is a complex formation, so it will have the value of the evidence in the presence of several elements: the media; procedural act which describes the origin of the media, the conditions and the circumstances of its discovery, extraction, and packaging. At the same time it is necessary to take into account the specific features of the specific information obtained with the use of information and communication technologies that define it as a separate category of evidence. In proceedings of cases concerning administrative offenses evidence existing in electronic-digital form on a on a tangible medium, should be considered in the general scientific and legal terms as independent evidence.
