Діяльність Національної поліції України з дотримання державних екологічних гарантій: теоретико-методологічний аспект

Abstract

Розглянуто повноваження органів поліції у сфері охорони навколишнього природного середовища та раціонального використання природних ресурсів. Заналізовано функціональні можливості вказаних правоохоронних органів із забезпечення екологічних прав. Доведено, що підрозділи Національної поліції України мають стати найзадіянішими органами в правоохоронній системі держави, найближче контактувати з населенням, що дасть їм змогу зреалізувати за допомогою різноманітних методик і форм цілу систему заходів, серед яких – із забезпечення екологічних прав людини. The units of the National Police of Ukraine have become the most widespread bodies in the system of law enforcement agencies of the state, they contact with the public closer than others do, and this gives the opportunity to realize (through a variety of techniques and forms) a whole system of measures, including measures of ecological human rights. The article deals with the powers of the police in the field of environmental protection and rational use of natural resources. Tasks relying on the police is an integral part of the state guarantees on providing citizens’ environmental rights. The immediate implementation of environmental powers by the police is carried out in the field of public order and public safety; during the inquiry and the pre-trial investigation in cases of environmental crimes, etc. The author analyzes regulations that establish the powers of the police in the field of environmental monitoring and environmental protection. A particular attention is paid to functional possibilities of the police to ensure environmental rights through the implementation of measures of administrative, operational-search, criminal-procedural activity. It is necessary to improve and specify legal documents defining the role of the police in the system of environmental protection, performance of environmental functions by precinct police inspectors serving the countryside, highlighting the organizational and legal aspects of their activities. The possibility of creating ecological police is considered.
