Конституційні гарантії прав і свобод людини та громадянина: сучасні українські реалії

Abstract

Розглянуто важливий аспект окресленої проблематики, що укладається у змісті поняття «конституційні гарантії» як виду нормативно-правового закріплення цих гарантій. З’ясовано дієвість забезпечення дотримання, виконання, застосування і використання конституційних та інших норм права у сучасних реаліях. Акцентовано на доцільності у сучасному конституційному процесі, зауважено на потреби реформування статей другого розділу Конституції України. Проаналізовано здійснені Конституційною Комісією при Президентові України напрацювання змін до згаданого розділу Основного Закону. Dealing with the basic regulations of theory of human rights, concerning actuality of through research of this institution in the conditions of carrying out constitutional reform in our country, the aspect of mentioned problematic is considered, which is involved in the content of the notion «constitutional guarantee», as type of normative-legal consideration of these guarantees. The efficiency in current reality of providing, following, carrying out and applying constitutional and other legal norms by the bodies of public authorities, local government, their officials, responsible physical and legal entities are clarified in the article. Focus is made on the expediency in modern constitutional process not to avoid the due attention of the requirement of reformation of articles of the second chapter of the Constitution of Ukraine for the purpose of their approach to modern common-European norms and legal standards. It ascertained, that created by the Constitutional Commission on the basis of Presidential Decree development of changes to Basic Law, in particular, the project of reformation of the above mentioned second chapter prepared by the workgroup, present the renewed chapter «Human rights». On the basis of analyses of 5 articles of current Constitution of Ukraine in the project of renewed second Chapter is found out, that how expedient, essential and grounded, concerning social-political and social-economical situation in Ukraine, should be considered optimal suggested changes for providing guarantees of rights and freedoms of a person and a citizen, and whether completely applied suggestions of Lviv scientists, which contained serious of recommendation, based on considered basic international documents (for example, European social Charter); as well as the attempt of estimate the renewed second Chapter of the Constitution of Ukraine concerning perspectives of improvements of mechanisms of the protection of human rights are carried out, and implementation of the international human rights standards into national legislation.
