Парламентський контроль у системі державного контролю

Abstract

Розглянуто проблеми парламентського контролю в системі державного контролю, їх співвідношення. Розкрито форми державного контролю, зокрема парламентського. Висвітлено роль парламентського контролю у системі державного контролю, його об’єкт і функції з огляду на досвід країн-членів Європейського Союзу у сфері діяльності органів виконавчої влади. Подано авторське визначення парламентського контролю. The article deals with the issues of parliamentary control in the system of state control and their interrelation. On the basis of the analysis of the provisions of the Constitution of Ukraine, other normative and legal acts the author reveals forms of state control, including parliamentary control and its role in the system of state control, the object of parliamentary control, functions of parliamentary control in the context of the experience of the member states of the European Union in the sphere of the activity of executive bodies. The author’s definition of parliamentary control is given. The control occupies an important place in the activities of the Verkhovna Rada of Ukraine. State control is derived from the essence of power and the State. But as any element of these categories it has its place in public administration. This place is defined by the functions of the state administration, objectives and hierarchy of state power and socially necessary division of labour. Parliamentary control, as one of the types of state control, is a prerequisite for sustainable constitutional order in the country. The problem becomes significant because today there are no available normative and legal acts regulating the procedures for the exercise of parliamentary control, which is one of the most important instruments for ensuring the rule of law and implementation of the modern legal policy, a model of the interaction between different branches of power in settling the most urgent issues related to further development of the country, making a unified approach to the definition of the essence of parliamentary control. State control is a common form of the activity of state bodies and officials, because in all spheres of public administration higher state authority always carries out any form of control over subordinate authorities. The control function belongs to the state in general. Based on the principle of power division, the common control function is delegated to the bodies of legislative, executive and judicial power. As a consequence, one of the most important forms of state control is parliamentary control. Parliamentary control is the activity of the legislative (representative) body of state power, its members and formed bodies of monitoring the legality of public authorities, their officials and other persons with the purpose of further evaluation of their activities and possible application of response measures.
