Екологічна функція держави: теоретико-правове дослідження: автореферат

Abstract

У дисертації здійснено комплексне теоретико-правове дослідження екологічної функції держави. Розкрито методологічні особливості екологічної функції як складової системи функцій держави; виділено основні етапи дослідження екологічної функції держави. Охарактеризовано екологічну функцію держави як зумовлену специфікою ролі держави систему напрямів її діяльності, завдань, цілей та гарантій, що визначають ефективну екологічну спрямованість діяльності держави у взаємодії з громадянським суспільством. Запропоновано розглядати екологічну функцію держави як цілісну систему, структурними елементами якої є внутрішня та зовнішня підсистеми. Вказано, що наявність активної позиції держави в екологічній сфері та ефективна природоохоронна політика можуть гарантувати не лише якість життя, але й продовження його тривалості за рахунок зниження кількості факторів, які скорочують життя. Підкреслюється, що доступ до екологічної інформації є основною складовою реалізації екологічної функції держави. The thesis presents a comprehensive legal theoretical study of the State Ecological function. Methodological features of ecological function as a component of the State function system and its relationship with other State functions are concerned. There was characterized the State Ecological function, caused by the specifics of the State place, system perspectives, objectives, goals, and guarantees of the State activity, determining effective ecological focus of the state activity in collaboration with Civil Society. According to study the State Ecological function is a hollistic system, whose structure includes internal and external subsystems and this function can be divided into ideological, normative and functional levels. The active position of the State in the field of environmental quality and environmental policies serves as a guarantee not only quality of life but also the extension of lifespan by reducing the number of life reducing factors. It is emphasized that access to ecological information is a key element in the process of implementation and realization of State ecological function.
