Предмет відомчого нормативно-правового регулювання діяльності міліції

Abstract

Досліджено нормативно-правове регулювання діяльності міліції, особливості якого залежать від змісту та природи предмета правового регулювання. На підставі аналізу нормативно-правової бази, якою регулюється діяльність міліції, запропоновано серед суспільних відносин, котрі становлять предмет загального нормативно-правового регулювання діяльності міліції виокремлювати службові відносини, що врегульовані відомчими нормами, і становлять предмет відомчого нормативно-правового регулювання. Total ensuring of human rights and freedoms, state responsibility to a man, productive work of the law enforcement agencies, especially the police is an essential condition for building the rule of law. The article emphasize that the effectiveness of the police along with the improvement of the forms and methods of combating crime is related to the peculiarities of the normative and legal regulation of the appropriate activity. The basis of the normative and legal regulation of Ukrainian law enforcement activity involves the formation of the regulatory framework as a legal means of achieving real ordering of police activity. The features of legal regulation depend on the content and nature of the subject-matter of legal regulation. The problem of legal regulation has been the object of close attention of scientists in various fields of jurisprudence for a long time. These acts are criticized most often. However, legislative regulation can’t cover all relationships, leaving a rather large range of institutional relations for departmental normative and legal regulation. Therefore, in the process of legal impact of the Ministry of Internal Affairs of Ukraine by means of regulations, a large number of subordinate bodies and institutions is governed by specific departmental normative and legal regulation with proper subject of regulation. Due to this, the control over the matching the content of departmental regulations (including their limited authorized access) to the law and implementing of suggestions to establish the responsibility of officials for issuing regulations contradicting them. Not always the rules and regulations of departmental acts correspond to, and sometimes conflicting laws, but some of them have rules that restrict the rights and legitimate interests of citizens. In this regard, an important theoretical and practical meaning has the diversified development of the problem of the subject-matter of normative and legal regulation of police activity, namely those social relations that are regulated by departmental normative and legal acts.
