Конституціоналізм правової держави: інтерпретаційні підходи Б. Кістяківського

Abstract

Розглянуто конституційні основи правової держави, одним із адептів і теоретиків якої був Б. Кістяківський; велике наукове значення для юридичної науки має концепція такого типу держави, обґрунтуванню якої присвячено низку праць цього видатного вітчизняного теоретика права, послідовного прихильника розвитку і впровадження конституціоналізму як визначеної категорії характеристики найоптимальнішої форми державності, за якої зміцнюється й поглиблюється демократизм конституційної системи, розширюється й якісно зростає народне представництво, гарантується недоторканість прав та свобод людини і громадянина; проаналізовано інтерпретаційні підходи вченого до осмислення значення принципів конституціоналізму для засадничих підстав формування правової держави. Prominent Ukrainian law theorist, philosopher and sociologist B. Kistyakivskiy attached great importance of the search and the grounding of the theoretical principles of the constitutional order. According to his concept of the legal state the development of constitutionalism is grounded, his effective introduction of principles to practice of the creation of the state as one of the most essential conditions of realization of public ideal – imposition of the constitutional system first of all in the legal state. A number of works of the Ukrainian jurist is devoted to this range of problems, among which the following essay must be noted (according to the author) «State and Personality», where he developed the idea, mentioned in the journal’s article «Legal and Socialist State». In these publications he appeared as adherent and theorist of the legal state, at the same time B. Kistyakivskiy declared himself to the scientific society as the consistent supporter of constitutionalism. Exactly on that ground the democracy of the constitutional system changes and getting deeper, people’s representation broadens and grows qualitatively, inviolability of rights and freedoms of person and citizens is guaranteed. The interpretative approaches of the Ukrainian jurist to the comprehension of the value of the principles of the constitutionalism for the basic grounds of the development of the legal state are analysed in the article. A number of ideas presented by the scientist over one hundred years ago (in particular concerning people’s representation as one of the conditions of decentralization of power) are actual for modern practice of state making.
