Тактика проведення освідування підозрюваного у кримінальному провадженні про умисне вбивство, вчинене в стані сильного душевного хвилювання

Abstract

Розглянуто кримінальні процесуальні підстави та тактику проведення слідчої (розшукової) дії освідування як першочергової під час розслідування кримінального провадження про умисне вбивство, вчинене в стані сильного душевного хвилювання. Проаналізовано поняття освідування у історичних джерелах і думках вітчизняних учених-криміналістів, окреслено авторський підхід до поняття «освідування». Вивчено проведення огляду одягу, що є на підозрюваному, обсягу оголення та застосування примусу до особи, що підлягає освідуванню. Встановлено коло осіб, що зобов’язані чи можуть залучатися до освідування, а також засоби та способи фіксації результатів освідування підозрюваного у кримінальному провадженні про умисне вбивство, вчинене в стані сильного душевного хвилювання .
