Класифікація адміністративних договорів, що використовуються у діяльності правоохоронних органів

Abstract

Досліджено питання щодо класифікації адміністративних договорів, що регламентують особливості діяльності органів публічної влади у правоохоронній сфері, зокрема їхню взаємодію. Проаналізовано наукові підходи щодо класифікації адміністративних договорів, зокрема адміністративних договорів, що використовуються в правоохоронній сфері. Наголошено на тому, що для розробки практичних рекомендацій щодо покращення застосування адміністративних договорів у діяльності правоохоронних органів, з урахуванням особливостей кожного виду адміністративного договору, істотне значення має їх класифікація. The problem of classification on administrative agreements regulating features of the public authorities' activity law enforcement area, and their interaction in particular is analyzed. Thus, this study analyzes existing approaches to classification of scientific administrative contracts, including administrative agreements that are used in law enforcement. Among others, the fact of the development of practical recommendations for improving the application of administrative agreements in law enforcement, taking into account the characteristics of each type of administrative contract is essential for their classification. Special attention was paid to scientific works by V. V. Ivanov, who highlights the regulatory agreements (the source of regulatory control) and individual legal agreement (the source of sub-normative regulation), O. V Demin, who offers all contracts for functional and meaningful nature separated into individual (legal facts) and regulatory (sources of law). The paper also analyzes the most complete classification of administrative agreements suggested by R. Kuibida in 2008, according to objective criteria and classification of administrative agreements regulating features of the activity of public authorities in law enforcement area, including their interaction suggested by A. M. Yarmak. It is stated that the fact that the development of practical recommendations for improving the application of administrative agreements in law enforcement area including the characteristics of each type of administrative contract is essential for their classification. The need for consolidation in the general part of administrative law, except the definition of administrative contract, as well as the classification of administrative agreements is subject to certain classification criteria by which agreements may differ among themselves. An own classification of administrative contracts is used in law enforcement area, according to it they could be divided into the following types: 1) coordination agreements, 2) subordinate contracts.
