Деякі проблемні питання щодо значення та умов допустимості отримання доказів у кримінальному процесі

Abstract

Розглянуто і досліджено питання щодо правил допустимості отримання доказів, що є однією з гарантій прав і законних інтересів учасників кримінального процесу; досліджено основні проблемні моменти щодо значення допустимості доказів та умов їх отримання, що обумовлено завданням достовірного знання про винуватість особи у вчиненні кримінального правопорушення. The article deals with the issue of the importance and terms of the evidence admissibility that is the guarantee of the participants’ rights and legal interests in criminal proceedings. The fundamental problem moments of the evidence admissibility and the obtaining terms that are stipulated in the task of the reliable knowledge of the person guiltiness of the committing a crime are analyzed.
