Про механізм реалізації прав і свобод людини

Abstract

Досліджено теоретичні аспекти поняття і структури механізму реалізації прав і свобод людини, проаналізовано його складові. Розглянуто різні підходи вчених до механізму реалізації прав і свобод людини, зокрема, діяльнісний та інструментальний. Зауважено на етимологію слова «механізм», що означає взаємоузгодженість частин, елементів і передбачає певну стадійність. Детально вивчено правозастосовну діяльність як елемент механізму реалізації прав і свобод людини. Встановлено, що певний інтерес становить роль юридичної відповідальності як специфічної гарантії захисту прав і свобод людини. Зроблено відповідні висновки та внесено пропозиції щодо прав і свобод людини та механізм їх реалізації. Human rights and freedoms are one of the essential issues in Ukraine, their recognition, guarantee, realization and protection are the crucial task of the state, as far as principle of priority of human rights and freedoms is secured in Constitution of Ukraine and forms meaning of its legal politics. The state activity should be governed on the protection of legal interests of citizens; creating social, legal, organizational and economical conditions, that provide rights and freedoms and personal development of any individual. The realization secured by the Constitution, laws of Ukraine ratified by international treaties norms and principles in the branch of human rights, including making the appropriate bodies of formation certain mechanism, that can provide their realization are essential direction of state politics. Level of providing human rights and freedoms testifies cultural and social level of societyʼs development and state in general. Providing the realization of human rights and freedoms is the main feature of modern democratic and civil society. That is why the issues concerning constituents of the mechanism of realization of human rights and freedoms are in consistent attention of scientists. The article studies theoretical aspects of the concept and structure of the mechanism of realization of rights and freedoms. The analysis of its constituent elements. The article considers different approaches of scientists to the mechanism of realization of rights and freedoms,in particular, activity and tool. Separately drawn attention to the etymology of the word «mechanism», that means consistency in the parts, elements and involves certain stages. Due attention is paid to enforcement activities as part of the mechanism of realization of the rights and freedoms of the individual. Of particular interest is the role of legal liability as a specific guarantee for the protection of the rights and freedoms of the individual. Relevant conclusions and proposals regarding the rights and freedoms of man and the mechanism of their implementation.
